Please read these Terms of Use ("Terms") carefully before using the Flowly - AI English Tutor application ("App") operated by Yunus Emre Güneş ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using Flowly, you confirm that you have read, understood, and agree to these Terms. If you do not agree, please do not use the App.
2. Description of Service
Flowly is an AI-powered language learning application that provides:
- AI conversation practice with virtual video tutors
- Structured lessons across multiple proficiency levels (A1–C1)
- Warm-up exercises (Scramble, Blitz, Gap Fill, Scenario)
- Real-time language evaluation and feedback
- Voice input and speech recognition for speaking practice
- Translation features with word-by-word mapping
- Daily learning content and progress tracking
3. Account Registration
- You must create an account to use the App. You can register using email/password, Google Sign-In, or Apple Sign-In.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must provide accurate and complete information during registration.
- You must be at least 13 years of age to create an account. If you are under 18, you represent that you have parental or guardian consent.
4. Subscriptions and Payments
4.1 Free Features
Flowly offers limited free access, including a free trial period and access to the first lesson of each level.
4.2 Flowly Pro Subscription
Flowly Pro is available as an auto-renewable subscription with the following terms:
- Plans: Weekly and Monthly subscription options are available.
- Free Trial: A 3-day free trial is included with your first subscription.
- Payment: Payment is charged to your Apple ID account at confirmation of purchase.
- Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
- Renewal Charge: Your account will be charged for renewal within 24 hours prior to the end of the current period at the subscription rate.
- Management: You can manage and cancel your subscriptions in your Apple ID Account Settings.
- Free Trial Forfeiture: Any unused portion of a free trial will be forfeited when you purchase a subscription.
4.3 Refunds
All purchases are processed through Apple's App Store. Refund requests must be directed to Apple in accordance with their refund policies.
5. AI-Generated Content
- Flowly uses artificial intelligence to generate language lessons, conversations, exercises, translations, and feedback.
- AI-generated content is provided for educational purposes only and may not always be 100% accurate.
- We do not guarantee that AI responses will be free of errors. Users should use their own judgment when applying language skills learned through the App.
- The App is not a substitute for professional language instruction, certified translations, or academic assessment.
6. Acceptable Use
You agree not to:
- Use the App for any unlawful or unauthorized purpose.
- Attempt to manipulate, exploit, or abuse the AI system to generate harmful, offensive, or inappropriate content.
- Reverse engineer, decompile, or disassemble any part of the App.
- Share your account credentials with others or allow multiple people to use a single account.
- Use automated scripts, bots, or other tools to interact with the App.
- Interfere with or disrupt the App's infrastructure or services.
7. Intellectual Property
- All content, features, and functionality of the App (including but not limited to design, text, graphics, logos, icons, audio, video, and software) are owned by us and are protected by intellectual property laws.
- The AI tutor characters (Chloe, Ethan, Maya, Amara, Hiro), their voices, and visual representations are our proprietary assets.
- You may not copy, modify, distribute, or create derivative works based on the App without our written consent.
8. Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to the data practices described in the Privacy Policy.
9. Disclaimer of Warranties
The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. We do not warrant that:
- The App will be uninterrupted, secure, or error-free.
- AI-generated content will be accurate, complete, or reliable.
- The App will meet your specific learning objectives.
10. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, including but not limited to loss of data, loss of profits, or business interruption.
11. Termination
- We reserve the right to suspend or terminate your account at any time if you violate these Terms.
- You may delete your account at any time by contacting us.
- Upon termination, your right to use the App will immediately cease, and any active subscription will continue until the end of the current billing period.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date at the top of this page. Your continued use of the App after any modifications constitutes acceptance of the updated Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.
